ver 4.4 in quirks mode on IE8

For certain reasons I need to keep running my app in quirks mode (<!DOCTYPE HTML PUBLIC "-//W3C//DTD HTML 4.0 Transitional//EN">), and I just tried to update my jqgrid version from 3.8.2 to 4.4.0. 
 
Following the upgrade, Firefox seems to be running file, however I am getting a “Grid can not be used in this (quirks) mode!” alertbox in IE8. If I’m not mistaken, I have seen comments on a forum post mentioning that this was put in intentionally for support purposes in version 4.4.
 
Now the options I am looking at are:
1.  Is there a way to make IE8 handle the situation like Firefox?
2.  Is there version I could downgrade to – so that I can be up-to-date as possible? I tried to look for a 4.3.2 download, but the downloads section only seems to have 4.4 and 3.8.2-back. Is there a way to download a specific version from github? 
3.  Rollback to 3.8.2
 
Any suggestions are appreciated…

My question will be: How can I disable the quirks mode? or how can I make JQGrid to display my Grid?
